General Terms and Conditions of Enrolment

Before enrolling in a language course, please read these General Terms and Conditions carefully. By clicking the “Sign up” button, the student (customer) accepts the provider’s offer for the foreign language course in accordance with the general terms and conditions stated below.

1. Course Enrolment and Data Usage Permission

By enrolling in the course, the student grants Lingula Language Centre, d.o.o., permission to inform them about the course schedule and any changes and to send satisfaction surveys and invitations to events prepared exclusively for Lingula students.

Lingula undertakes not to misuse or transfer student data to third parties.

The provider reserves the right to commercial use of photos and videos in which the student appears during the foreign language course, unless the student explicitly denies this permission.

2. Tuition and Payment Terms

2.1. Course Tuition

The student agrees to pay the course fees according to the price list, except in cases where the employer pays for the education. All prices are in euros and include VAT, unless otherwise specified.

2.2. Textbook Payment

Textbooks are not included in the tuition fee. The student can purchase them at Lingula upon enrolment or later, or they can obtain the materials themselves from a bookstore. In the case of a later purchase, the student agrees to pay the cost of the textbook within eight (8) days of receiving the invoice.

Lingula sells textbooks exclusively to its students, and they are not for sale to external customers.

2.3.  Payment Terms

2.3.1. Payment by pro forma invoice

In the online store, you can pay for your order in a single amount via a pro forma invoice. In your cart, select “Payment by pro forma invoice” as the payment method, and you will receive a pro forma invoice with a unique reference number at the email address you provided. You can pay the pro forma invoice via mobile or online banking, at your chosen bank’s physical branch or at other locations that allow bill payment. When paying, please pay attention to the reference number on the pro forma invoice.

Payment by card

You can pay with the following cards: Maestro, MasterCard, Visa, Visa Electron, V Pay, BA and Diners Club.

  • Visa and MasterCard: If the cardholder has enabled instalment purchases with the card issuer, they can split the payment into 2 to 12 instalments. The number of instalments and the instalment amount are within the available credit limit on the existing card.
  • Diners Club International card with the DC UV designation: The amount available for instalment payments depends on your card’s available credit limit. We offer the option of purchasing in 2 to 12 instalments, with a minimum instalment amount of €40.00.

Instalment payment by invoice (exclusively for 30- to 90-hour group courses)

The purchase amount is divided into 4 equal instalments; the first is paid upon enrolment, and the remaining 3 are paid in three consecutive monthly instalments according to the due dates on the invoice. You will receive an invoice with a specification for instalment payment within 3 days of purchase. The cost of approving an instalment purchase by invoice is €24.00 and is charged only once if you enrol multiple children at the same time.

2.3.2. Legal Entities

A legal entity pays the tuition in a single amount based on the pro forma invoice or invoice.

If more than 8 candidates from the same company are enrolled in the course, payment in multiple instalments is possible.

2.4. Late Payments

The provider reserves the right to charge statutory default interest in case of late payment. In the case of a longer delay, the provider has the right to collect the purchase price through legal action. In this case, the customer bears the costs of the enforcement.

The provider reserves the right not to allow instalment payments for the next semester to a student who is late with instalment payments by invoice.

3. Course Cancellation or Termination

Pošljiting the enrolment form is considered the conclusion of a distance contract (Article 43, first paragraph, of the Consumer Protection Act). The course is a leisure service for which the provider undertakes to fulfil their obligation within a precisely defined period, so the student does not have the right to withdraw from the contract within 14 days without stating a reason for their decision (point 12 of the fifth paragraph of Article 43c of the Consumer Protection Act). Despite the above, we do accept course cancellations, but no later than 14 days before the start of the course.

3.1. Student-initiated cancellation or termination before the course starts

For withdrawal from enrolment up to 14 days before the start of the course or other service, we charge a €30.00 handling fee (course, language holiday, language proficiency exam, e-course, etc.). If the service is less than 14 days away, we will retain 100% of the payment.

3.2. Student-initiated cancellation or termination during the course

Group course: By enrolling in a course at Lingula’s premises or remotely, the student agrees to attend the course for the scheduled period. The student agrees to pay the full tuition fee, unless they notify the provider in a timely manner of a justified reason for not being able to attend the course.  

A justified reason is considered to be an unforeseen event, such as a long-term illness (more than 30 days of sick leave with documentation). The student must provide the provider with a written certificate of the justified reason. Upon cancellation due to a justified reason, the student will be charged a €50.00 handling fee and a proportional payment for the number of hours held up to the end of the current month in which Lingula received the application for termination of the course. Tuition paid up to the time of termination is not refunded.

If a student stops attending a group course without prior notification to the provider or if the reason for cancellation is not a long-term illness (with documentation), the service is considered to have been performed as agreed, and the student is obliged to settle all obligations arising from the performance of the agreed service.

3.3.  Student-initiated cancellation or termination – Language Holidays

In case of cancellation during the course, the amount paid is not refunded. An exception is cancellation for health reasons (upon presentation of a medical excuse). Upon cancellation for health reasons, the student is charged a €30.00 handling fee and a proportional amount for the number of hours delivered up to the day of termination when Lingula received the application for termination of the course. Tuition paid up to the time of termination is not refunded.

  • If a student cannot attend a scheduled lesson, they must notify the reception office at least 24 hours in advance at 040 644 544 (Mateja). If the student reports their absence less than 24 hours before the appointment, the lesson is considered to have been held.
  • For courses longer than 30 hours, the student can pause the course once for up to 60 days, but we cannot guarantee continuation with the same teacher and at the same scheduled time after the break.
  • Within the course, the student can reschedule up to 20% of the meetings. If there is a need for greater adjustments or longer periods when the course is not running, we are, of course, flexible, but in this case, we cannot guarantee the same teacher.

3.5. Provider-initiated Course Cancellation

In accordance with applicable law, the provider, Lingula Language Centre, reserves the right to cancel a course no later than 5 days before the scheduled start if the minimum number of students specified in the conditions do not enrol, or if the students do not agree to the proposed smaller number of hours. Any tuition already paid will be refunded without interest.

4.  Course Implementation

4.1.Placement Interview

For all new candidates enrolling in a continuing course, a placement interview is required (15 to 30 minutes) and, if necessary, a written placement test (60 minutes), after which we suggest the most suitable group at the appropriate language level. The provider reserves the right to place the student in a group based on the completed placement interview, based on their current language level, which may differ from the level the customer applied for.

The student can complete the placement interview in person at Lingula’s premises or remotely via the Teams application.

4.2. Group Course Implementation in Case of Fewer Enrolments

4.2.1. Courses for Adults

Group course (6 to 8 participants) The provider will conduct the course for the scheduled number of hours if at least six participants are enrolled in the group. If fewer than six participants are enrolled in the group, the provider will conduct the course for a proportionally smaller number of school hours, but in such a way that the planned programme is completed in its entirety.

  • 90-hour course: if 5 participants are enrolled, 80 school hours are conducted. If 4 are enrolled, 70 hours are conducted, and with 3, 60 hours are conducted.
  • 60-hour course: if 5 participants are enrolled, 52 school hours are conducted. If 4 are enrolled, 45 hours are conducted, and with 3, 35 hours are conducted.
  • 45-hour course: if 5 participants are enrolled, 40 school hours are conducted. If 4 are enrolled, 35 hours are conducted, and with 3, 30 hours are conducted.
  • 40-hour summer course: if 4 participants are enrolled, 32 school hours are conducted, and if 3 are enrolled, then 30 school hours are conducted.
  • 30-hour course: if 5 participants are enrolled, 26 school hours are conducted. If 4 are enrolled, 24 hours are conducted, and with 3, 20 hours are conducted.
  • 20-hour summer course: if 4 participants are enrolled, 16 school hours are conducted, and if 3 are enrolled, then 14 hours.
  • 12-hour workshop with 4 to 8 students: if 3 participants are enrolled, the programme is covered in 9 school hours. If 2 participants are enrolled, 6 school hours are conducted.
  • 40-hour course in a mini-group (3 to 5 participants): if 2 participants are enrolled, the programme is covered in 26 hours.

4.2.2. Courses for Children

Group course (5 to 8 participants) The provider will conduct the course for the scheduled number of hours if at least 5 children are enrolled in the group. If fewer than 5 participants are enrolled, the provider will conduct the programme for a proportionally smaller number of hours or, in agreement with the parents, will increase the tuition fee. The maximum number of children in a year-round course is 8, and in a summer course, it is 11.

  • 60-hour course: if 5 children are enrolled, 52 school hours are conducted; with 4 children, 46 school hours are conducted; and with 3 children, 36 school hours are conducted.
  • 55-hour course: if 5 children are enrolled, 50 school hours are conducted; with 4 children, 45 school hours are conducted; and with 3 children, 35 school hours are conducted.
  • 44-hour course: if 5 children are enrolled, 40 school hours are conducted; with 4 children, 45 school hours are conducted; and with 3 children, 35 school hours are conducted.
  • 45-hour course Priprava na maturo: if 5 children are enrolled, 40 school hours are conducted; with 4 children, 35 š. ur are conducted; and with 3 children, 30 school hours are conducted..

4.2.3. Summer Language Holidays

  • The provider will conduct the 20-hour course for the scheduled number of hours if at least 5 children are enrolled in the group.
  • If fewer than 5 participants are enrolled, the provider will conduct 15 hours of the course or, in agreement with the parents, will increase the tuition fee.
  • The maximum number of children in a summer course group is 11.

4.3. Change of Schedule or Group

A change of schedule or transfer from one group to another is possible on the condition that it does not affect the existence of the group the student is enrolled in and that the level of knowledge is appropriate. The administrative costs of the transfer amount to €30.00. If, at the suggestion of Lingula or the student, the student transfers to another group because their level is too high or too low for the current group, the administrative transfer fee will not be charged. Upon transferring to a new group, the student agrees to cover the material that the group has already covered.

Upon changing group, the student cannot return materials that have already been used to the provider.

4.4. Course Start Notification

The student will receive a notification about the start of the course no later than five (5) days before the course begins. If the student provided an incomplete or incorrect address for the purpose of receiving an invoice and subsequent course notifications or sending learning materials, the student is responsible for the consequences.

If the student does not receive the start notification within the specified period because they provided the wrong address or because Lingula’s email went to spam/junk mail, they are obliged to contact the provider themselves and request it. The provider will not accept complaints regarding unreceived mail for the aforementioned reasons.

5. Limitation of Liability Regarding Progress

Lingula’s language courses are conducted in accordance with the Common European Framework of Reference for Languages (CEFR). The guidelines published by the provider regarding the number of teaching hours required to achieve a certain level of knowledge are based on the CEFR scale but may differ from actual requirements in individual cases. An individual group or student may need more hours to reach a certain language level.

6.  Complaints, Claims and Dispute Resolution

Any disputes will be resolved amicably. If a dispute cannot be resolved amicably, the competent court in Ljubljana shall have jurisdiction.

7. Change of Terms

The provider reserves the right to unilaterally change the terms of business, tuition fees and offers published on the website https://trgovina.lingula.si/splosni-vpisni-pogoji-poslovanja/ and https://www.lingula.si/splosni-pogoji/ at any time. The changes take effect upon publication on the website or upon written notification to the customer via email. The customer is bound by the terms, prices and offers that are valid on the day the order is submitted.
